I have just had some bad news at work the company i work for has decided to lay off 60 staff i am one of them i am very devastated.I have worked with this company for about 15 years as a loyal member of staff in the aviation industry and also its my hobby.I was given the option to take 6 months unpaid leave or take the redundancy payment with only a week to decide i choose redundancy i feel i was forced or rushed into choosing i feel i have been unfairly treated,the reason of me being picked is the so call Bradford factor points system which aim at:fail to joins 0disaplinarys 0time keeping 0sick 40All based on the number of occations 10 points each for sick.which came in within 18 months ago in to our company I have had a very good attendance record in the past to date in the last 18 months i have had no fail to joins disaplinarys time keeping 100% but i have only penilised for my sick due to some light operations on my legs which ment that i had to have at least 2 sessions off within a 10 week period also on the recommendation of the my local doctor and the doctors at the hosptial not to work with paper work all cover my appointments if the operations where not done i my of had ended up with {dvt} this is what you call very bad timing especially with the current climate.I am in the union and have appealed against the companys choose i am waiting for the the next interview.but putting this messege out hopefully someone may be able to see if there is a fault with this points system.I say again i apoligise for putting this message out i am desparate need for any legal advice. Unfortunately I can't offer you any legal advice, but I do want you to know that when one door closes another one always opens. Something beyond what you could ever imagine is out there waiting for you. I hope you don't mind me saying, but after 15 years with the same company, it really is time that you moved on. You need to be out there exploring new things and taking hold of new opportunities. robert sadler Posted October 24, 2009 at 11:54 PM Author Posted October 24, 2009 at 11:54 PM Thank you for your replys I would say as i have been in the same company for 15 years i have worked in the aviation industry for over 25 years i am finding it very diffcult to get over it i am looking for other work currently but but not much luck at the moment, i am working with the union to see if what the company has done to me,so far they have come up with unfair dismisal on the bases of unlawfull diabililty discrimantion with the bradford factor points system this may be something of a start of something seroius against the company hopefully the employer adviser might come up with something all i want to do is try and get my job back.I shall not give up just yet. robert sadler Posted October 31, 2009 at 12:16 AM Author Posted October 31, 2009 at 12:16 AM Hi everyone there is light at the end of the tunnel for me my union rep has told me that my company may of discrimanated against my long term illness under the Disability Discrimination Act.this apparently means that there is a stong possiblity that my that the company may of used the bradford fator unlawfully or incorrectly so the union rep has told me when I go the the appeal meeting the union will hit the company with the unlawful Disability Discrimination Act I am to reject any offers of redundance or any other sort of offer under the table i am only to accept full time employment and same contract with compansation for the trouble they have caused me on my unions terms.This is so much of a relief that there stands a very good chance i am going come out on top but feel bad on how the company has treated me and going back in to my medical records which seem to brought back some bad memorys which i was not inpressed with especially as i have been a loyal member of staff for 15 years. perhaps i also should add to get the company all expences payed to see a couple of shows to see celine in her next concerts with front row seats.........But i am dreaming but it would be nice though as a bonus.
